2021 MercedesTrophy Tournament Conditions

By participating in any or all of the 2021 MercedesTrophy events (being the Retailer Golf Day, National Final or World Final) (the "MercedesTrophy") you are indicating acceptance of the below guidelines, terms and conditions.

General

1.     The MercedesTrophy is a worldwide exclusive series of invitational golf tournaments initiated by Mercedes-Benz AG ("MBAG") and carried out by authorised Mercedes-Benz Passenger Car and Mercedes-Benz Vans Retailers.

2.     Participation in the MercedesTrophy is strictly by invitation only.

3.     Participants must be invited by a Dealer Principal of a participating authorised Mercedes-Benz Retailer to participate in a MercedesTrophy Retailer Golf Day ("RGD" or "Retailer Golf Day").

4.     The eligible place getter(s) of each Retailer Golf Day, or participating Retailer may be invited by Mercedes-Benz New Zealand Limited ("MBNZ") to take part in the MercedesTrophy New Zealand National Final (the "National Final").

5.     The MercedesTrophy World Final is a unique golf event which is held in Stuttgart, Germany (the "World Final"). Participation in this event is by invitation only from the host, MBAG. MBAG may invite up to three participants from New Zealand to take part in the World Final, being the three best eligible place getters who competed in the National Final (as determined by MBNZ in accordance with these terms and conditions).

Eligibility Criteria

6.     In order for participants to be eligible to play in the National Final and World Final, certain criteria must be met. Participants must:

a.             be over 18 years of age as at the date of participation in the Retailer Golf Day;

b.            hold a current New Zealand Handicap registered with Golf New Zealand (“Golf NZ”)

c.             be an amateur golfer (as defined by The R&A Ltd and USGA http://www.randa.org/Amateur-Status/MainRules/1-Amateurism);

d.            be the registered owner and primary driver of a new (includes Demonstrator models) Mercedes-Benz Passenger Car, X-Class or Van (as defined below) at the time of both the invitation to the Retailer Golf Day and at the time of the National Final unless MBNZ agrees otherwise in its absolute discretion;

e.             only take part in one Retailer Golf Day per year;

f.              meet any eligibility requirements of the host golf club; and

g.            have only one entry per new Mercedes-Benz (as defined below) at the National Final, even if that vehicle has multiple owners. For example, where there are two owners of a new Mercedes-Benz, the same vehicle cannot be used to make both owners eligible to attend the National Final nor can the same vehicle be used to make the second owner eligible in subsequent years.

7.     A “New Mercedes-Benz” is a new in New Zealand Mercedes-Benz passenger car, van or utility vehicle (“ute”) purchased from an authorised Mercedes-Benz Retailer in New Zealand at the time of both the invitation to the Retailer Golf Day and at the time of the National Final unless MBNZ agrees otherwise in its absolute discretion.

8.     For customers that have purchased a New Mercedes-Benz from an authorised Mercedes-Benz Retailer as:

a.            individuals or sole traders, players must be the registered owner, primary driver or spouse of same;

b.            public or private companies or other entities, players must be a registered director of the company, or a Retailer-nominated purchaser/fleet contact.

9.     MBNZ may refer to the relevant vehicle offer and sale agreement and/or vehicle registration to determine in its absolute discretion whether a person is eligible.

10.  Subject to any restrictions on eligibility in these terms and conditions, including in clause 13, participants who have previously taken part in a National Final may only participate in a National Final every four (4) years. This will mean that for customers who participated in a National Final in 2017 or earlier will now be eligible to re-participate (subject to any restrictions on eligibility).

11.  Subject to any restrictions on eligibility in these terms and conditions, including in clause 13, MBNZ may agree in its absolute discretion to waive the four (4) year stand down period or any other restriction in relation to participation at a National Final if the customer purchases a New Mercedes-Benz subsequent to their earlier Mercedes-Benz with which they previously qualified for a National Final. The New Mercedes-Benz must have been purchased from an authorised Mercedes-Benz Retailer in New Zealand within the 6 months preceding the Retailer Golf Day.

12.  Ineligible participants may be invited to take part as a participant in a Retailer Golf Day but are not eligible to be considered for the 2021 National Final or 2021 World Final, and are unable to be placed.

13.  Notwithstanding anything to the contrary in these terms and conditions:

a.             participants who have previously taken part in a World Final are not eligible to take part in any further National Final;

b.            participants who have previously taken part in a World Final are not eligible for any further World Final events; and

c.             participants who have previously won the Drive to the Major are not eligible to take part in any further Drive to the Major events but, subject to the restrictions in clauses 13(a) and (b) above, remain eligible to attend a World Final and another National Final subject to re-eligibility in clauses 10 and 11.

14.  Employees, their partners and associates of MBNZ and its related entities, employees of its authorised retailers, or its marketing partners are able to compete in the MercedesTrophy Retailer Golf Days, however they are not eligible to be placed in the National Final or World Final. 

15.  Participants must play in accordance with and abide by the Rules of Golf as issued by The R&A Ltd & USGA effective 1 January 2019 together with the tournament conditions and Local Rules as issued on the day by the Tournament organisers and the host golf club. Failure to do so may result in the participant not being eligible to take part in MercedesTrophy events and/or result in disqualification.

Participant Handicaps

16.  Only current New Zealand handicaps under the World Handicap System, registered with Golf New Zealand’s DotGolf system may be used at MercedesTrophy events. Club Handicaps or handicaps from a golf club or organisation outside of New Zealand are not valid.

17.  Maximum handicap indexes are 36.0 for men and 36.0 for women as registered and verified within the Golf New Zealand’s DotGolf system. Any handicap submitted that exceeds these figures will be reduced to the applicable maximum.

Scoring records must be submitted on the scorecard as issued (i.e. scores via the DotGolf APP will not used) In the normal way all scorecards must be signed by the player and marker. All signed scorecards must be handed into the tournament team (in the respective clubhouse) within 30 minutes of the completion of their round to be eligible for daily results.

21.  Participants’ approved handicaps must reflect his/her actual playing ability. Each participant shall be handicapped for each qualifying event as thought appropriate by the Match Committee at its sole discretion. Where the Match Committee considers, in its discretion, that the approved handicap does not reflect the participant’s actual playing ability, the Match Committee may adjust that handicap at its sole discretion following guidelines from Golf New Zealand. This adjustment may be made to the player's score at the end of their round, thus adjusting their total.

22.  The Tournament organisers reserve the right to disqualify participants who are suspected of handicap violation and reserve the right to further disqualify participants from any or all future MercedesTrophy events. Amateur handicap infringements may be reported to Golf New Zealand.

23.  All Golf Club venues must input the scorecards of all participants who have current Golf New Zealand handicaps through the Golf New Zealand DotGolf system to ensure their handicaps reflect their true playing standard for future events (including the National Final).

24.  Current New Zealand handicaps registered with Golf New Zealand must be used at the National Final, unless:

a.             a participant’s handicap has reduced after the qualifying Retailer Golf Day, in which case the lower handicap figure must be used by the participant; or

b.            a participant’s handicap has increased since the qualifying Retailer Golf Day in which case the participant must use the handicap that was current at the commencement of the Retailer Golf Day (i.e. the lower of the two handicaps must be used).

25.  Eligible participants at the Retailer Golf Days will (subject to these terms and conditions) be eligible to receive prizes and qualify to be invited to attend the National Final in separate handicap divisions based on the size of the field and number of qualifying places, and otherwise as provided for in clause 34, 35, 36 and 37. Men and women shall compete against each other in the same field. There are no pre-defined handicap classes.

Rules of Play

26.  Each round in each qualifying event shall be played in accordance with the Rules of Golf as approved by The R&A Ltd and USGA, as interpreted or thought appropriate by the Match Committee at its sole discretion and modified in any event by the fact that its rulings and decisions are final. 

27.  Each Retailer Golf Day and the National Final will be run by a Tournament organiser appointed only for the duration of the relevant event and which is functus officio immediately following the announcement of the winners.

28.  Notwithstanding anything to contrary in these terms and conditions, all rulings and decisions of each Match Committee and the Tournament organisers shall be final, no appeal shall lie from them, and no correspondence shall be entered into for any reason after the conclusion of each event.

29.  Caddies and on-course coaches are not permitted at the Retailer Golf Day or National Final. Failure to adhere to this condition will result in disqualification from the tournament.

30.  Spectators at the National Final are permitted (no more than one per entrant) but are not permitted on the golf course and must not communicate with the players in any way once play has commenced.  Failure to adhere to this condition, can result in disqualification from the tournament.

31.  Women participants are to tee off from the designated tee and to use the ladies scorecard for scoring purposes. Possible adjustments for extra strokes will be calculated where the men's and ladies stroke rating is different as per Golf New Zealand guidelines.

32.  Scoring for the MercedesTrophy is Individual Stableford.

33.  Tie Breakers: in the case of two or more participants sharing the same Stableford score, a count-back system will be conducted as follows:

a.             The winner is determined as the participant who scores the highest number of Stableford points for the last 9 holes (holes 10 to 18).

b.            If there is still a tie, then the winner will be determined as the participant who scores the highest number of Stableford points for the last 6 holes (holes 13 to 18), then the last three holes (hole 16 to 18) and then hole by hole backwards from the 18th hole.

c.             In the event that scores are still tied then the winner will be determined by lot by the Tournament organisers.

d.            In the case of the National Final – the countback where 36 holes are played, would be the last 18 holes, then on holes 9, 6, 3, 1 and by lot as above.

Retailer qualification to the National Final

34.  At each Retailer Golf Day, all eligible participants in accordance with these terms and conditions will have the opportunity to compete for a number of places to participate in the National Final. The number of places available for the National Final are dependent on the status of the Retailer in respect of the relevant Retailer Golf Day (Tier 1 = 3 Winners, Tier 2 = 2 Winners and Tier 3 = 1 Winner).

35.  For the Tier 1 Retailer Golf Days, the National Finalists will be determined using the below qualification route:

a.             Three (3) finalists will be determined from the highest, eligible Stableford points score from three (3) dynamic handicap classes – A Grade, B Grade, C Grade.

b.            Handicap classes for each of A Grade, B Grade and C Grade will be determined dynamically by sorting all players' NZ Golf handicaps into ascending numerical order and dividing the field into three (3) evenly distributed handicap categories.

c.             A winner from each handicap class (A Grade, B Grade, C Class) will then be determined.

36.  For Tier 2 Retailer Golf Days, the National Finalists will be determined using the below qualification route:

a.             Two (2) finalists will be determined from the highest, eligible Stableford points score from two (2) dynamic handicap classes – A Grade and B Grade.

b.            Handicap classes for each of A Grade and B Grade will be determined dynamically by sorting all players handicaps into ascending numerical order and dividing the field into two (2) evenly distributed handicap categories.

c.             A winner from each handicap class (A Grade, B Grade) will then be determined.

37.  For Tier 3 Retailer Golf Days, the National Finalists will be determined using the below qualification route:

a.             A single winner is determined from the highest, eligible Stableford points score of all players participating in the Retailer Golf Day.

National Final qualification to World Final 

38.  At the National Final, all eligible participants in accordance with these terms and conditions, will have the opportunity to compete for one of three places to participate in the World Final (subject to these terms and conditions). 

39.  According to the World Handicap System, handicaps will change daily

40.  The World Finalists will be determined using the below qualification route:

a.             The World Final team will consist of three (3) Stableford winners determined from three (3) different handicap classes – A Grade, B Grade, C Grade.  

b.            No predefined handicap classes exist.

c.             Dynamically generated handicap classes for each of A Grade, B Grade and C Grade will be determined by sorting all players into ascending numerical order based on their Golf New Zealand handicaps and dividing the field into three (3) evenly distributed handicap categories. 

d.            A winner from each handicap class (A Grade, B Grade, C Class) will then be determined. 

e.             While handicaps will change daily, players will remain in the same division as per day one, for the duration of the tournament and the awarding of daily and overall prizes.

Drive to the Major

41.  Subject to these terms and conditions, at the National Final, participants will have the opportunity to win a once in a lifetime prize through a straightest drive competition (the "Drive to the Major"). The eligible participant who hits the ball nearest to the marked line on the hole selected, and adjudged by the Match Committee of the National Final, will win an amazing experience at the Open 2021 Royal St. George’s Golf Course, Sandwich, Kent (the "Open").  Participation in the Drive to the Major is subject to the eligibility of participant's in accordance with these terms and conditions and excludes participant's not eligible under clause 45(a).

42.  Subject to these terms and conditions, the winner of the Drive to the Major ("Winner") will receive:

a.             return business class flights from Auckland to London on an airline of MBNZ's choice (Airfares must be booked by MBNZ on behalf on the Winner. Travel companions or partners are required to meet the cost of their own airfares but flights can be organised in conjunction with the Winner by MBNZ);

b.            twin share accommodation for five nights for the Winner and their travel companion/partner;

c.             transfers to and from the airport in London to the place of accommodation for the Winner and their travel companion/partner;

d.            transfers to and from the place of accommodation to the Open for the Winner and their travel companion/partner;

e.             admittance to the Open for 15th, 16th, and 18th July 2021 including admittance to the private Mercedes-Benz VIP hospitality area for the Winner and their travel companion/partner; and

f.              participation in the ‘Drive to the Major’ qualification tournament.

43.  If the first place eligible participant is unable or unwilling to attend, the prize will be given to the eligible participant with the next closest ball to the marked line. If that participant is unable or unwilling to attend then the prize will be forfeited.

44.  In no circumstances will the prize be redeemable as cash and neither MBNZ nor MBAG will be obliged to compensate the participant in anyway who is unable or unwilling to attend.

45.  Notwithstanding anything to the contrary in these terms and conditions, if the National Final and/or the Open is cancelled or postponed for any reason and/or MBNZ or MBAG determine that having held the Drive to the Major it is inappropriate to give all or any part of the prize for the Drive to the Major (for example, having regard to any government mandated or recommended COVID-19 lockdown requirements or social distancing guidelines) and/or if there is any change to the qualification and participation criteria at any point in relation to the National Final and/or Drive to the Major (including in relation to whether guests and spectators (and companions and partners) can attend) (including having regard to any government mandated or recommended COVID-19 lockdown requirements or social distancing guidelines), neither MBNZ nor MBAG will be obliged to compensate the participant or any guest or spectator (or companion or partner) in any way.

46.  Notwithstanding anything to the contrary in these terms and conditions:

a.             former Winners of the Drive to the Major or events similar to the Drive to the Major are not eligible to win future Drive to the Major competitions at any National Final;

b.            journalists are not eligible to participate in the Drive to the Major competition; and

c.             Participation in the World Final and the Drive to the Major by the same eligible participant is not possible in the same calendar year. If a participant is the first eligible participant in the Drive to the Major and also qualifies for the team to attend the World Final, their qualification for the World Final has priority. In this instance, subject to clause 42, the next best placed competitor in the Drive to the Major competition who is an eligible participant will be named the Winner.

47.  Handicap Limits apply for the Drive to the Major competition played at the Royal St. George’s Golf Course, Sandwich, Kent:

a.             Women: Handicap of Max. 36

b.            Men: Handicap of Max. 28

48.  It is the responsibility of the Winner of the Drive to the Major and their travel companion/partner to ensure that they have valid passports, and any requisite visas, vaccinations and travel documentation, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities, will be the sole responsibility of the Winner. MBNZ strongly recommends that the Winner purchases travel insurance.

Expenses

Retailer Golf Day

49.  Mercedes-Benz Retailers will meet the cost of any green fees for any Retailer Golf Day. Retailers may provide motorised carts at their discretion. A medical certificate may be requested to confirm the authenticity of a medical condition that may require the use of a cart.

National Final

50.  Subject to these terms and conditions, MBNZ will meet the following expenses of National Final participants:

a.     green fees;

b.    cart hire (the participant is responsible for any repair costs of the cart if it is damaged while they are driving it);

c.     reasonable cost of twin-share accommodation (including breakfast) to be shared with their travel companion/partner, on Friday 23rd and Saturday 24th April 2021 at an establishment of MBNZ’s choice;

d.    reasonable cost of return economy airfares from the city closest to where the participant lives to Queenstown airport, on an airline of MBNZ’s choice;

e.     return transfers from Queenstown airport to the place of accommodation; and

f.      food and beverage at official National Final events as outlined in the official event programme including:

                                          i.    a welcome dinner on Friday night;

                                         ii.    an on-course lunch during competition play on Saturday;

                                        iii.    a group dinner on Saturday night; and

                                        iv.    an award ceremony lunch on Sunday afternoon

51.  Subject to these terms and conditions, one travel companion/partner per participant is able to attend the National Final as a guest and spectator. The travel companion/partner is required to meet the following expense:

a.            $575 (inclusive of GST) to be paid in full no later than Monday 19th April 2021; and

b.            the cost of their own airfares to and from Queenstown airport. Flights can be organised in conjunction with the participant's flights by MBNZ.

52.  After meeting the costs as set out in clause 50, MBNZ will provide the following for the travel companion/partner to the National Final (subject to these terms and conditions): 

a.             reasonable cost of twin share accommodation (including breakfast), to be shared with the participant, on Friday 23rd and Saturday 24th April 2021 at an establishment of MBNZ’s choice;

b.            return transfers from Queenstown airport to the place of accommodation;

c.             food and beverage at official National Final events as outlined in the official event programme including:

                                         v.    a welcome dinner on Friday night;

                                        vi.    an offsite group lunch on Saturday;

                                       vii.    a group dinner on Saturday night; and

                                     viii.    an award ceremony lunch on Sunday afternoon.

53.  Except as set out in clauses 49 and 51 all other expenses associated with attending the National Final as a participant or travel companion/partner are to be met by the participant or travel companion/partner, including without limitation spending money, additional meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure point including fuel and parking costs, additional transfers, items of a personal nature, in-room charges and all other ancillary costs.

World Final

54.  Subject to these terms and conditions, MBNZ will meet the following expenses of World Final participants:

a.     green fees;

b.    reasonable cost of twin-share accommodation (including breakfast), to be shared with their travel companion/partner for the duration of the World Final, at an establishment of MBNZ’s choice;

c.     reasonable cost of return airfares from the city closest to where the participant lives, to Auckland airport, in the event the participant lives out of the Auckland area;

d.    reasonable cost of return business-class airfares from Auckland to Frankfurt, Germany, on an airline of MBNZ’s choice; and

e.     return transfers from Frankfurt Airport to the place of accommodation in Stuttgart.

55.  Subject to these terms and conditions, one travel companion/partner per participant is able to attend the World Final as a guest and spectator. The travel companion/partner is required to meet the following expenses:

a.    the cost of their own airfares and transfers to the place of accommodation in Stuttgart. Flights can be organised in conjunction with the participant's flights by MBNZ.

56.  Subject to these terms and conditions, after meeting the costs as set out in clause 54 MBNZ will provide the following for the travel companion/partner to the World Final:

a.    return transfers from the place of accommodation in Stuttgart to the World Final tournament.

57.  Except as set out in clause 55 all other expenses associated with attending the World Final as a participant or travel companion/partner are to be met by the participant or travel companion/partner, including without limitation spending money, additional meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure point including fuel or parking costs, additional transfers, items of a personal nature, in-room charges and all other ancillary costs.

58.  It is the responsibility of the MBNZ World Final participants and their travel partner/companion to ensure that they have valid passports, and any requisite visas, vaccinations and travel documentation, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities, will be the sole responsibility of the participant and their travel companion/partner. MBNZ strongly recommends that participant and their travel companion/partner purchase travel insurance.

59.  MBNZ may, in its absolute discretion, allow the participants and their travel companion/partner to arrange their own bookings for the airfares to the National Final and World Final, or to nominate a travel agent to make a booking on their behalf, subject to appropriate payment arrangements being agreed which are satisfactory to MBNZ in its absolute discretion. For clarity, should MBNZ agree to a participant and their travel companion/partner arranging their own bookings, then in the event that the booking is cancelled (for any reason whatsoever), any refunds must be paid by the participant and their travel companion/partner immediately to MBNZ and the participant and their travel companion/partner will be responsible for any associated cancellation fees.

General

60.  Each participant in any MercedesTrophy event acknowledges (including without limitation each of the Invitees) and agrees that, to the extent permitted by law, MBNZ, MBNZ’s Retailers and MBAG (and any related company (as defined in section 2(3) of the Companies Act 1993, provided that reference to company in that section extends to any body corporate wherever incorporated or registered) of MBAG (each a "Released Entity" and together the "Released Entities") will, to the extent permitted by law, not be liable to any participant (or to any person claiming through or on behalf of a participant) for:

a.             any loss, damage, cost, or claim arising out of or in connection with any death or personal injury which is or may be suffered by any participant in connection with any MercedesTrophy event including as result of a breach of any consumer laws in New Zealand or elsewhere (if applicable); and

b.            any other loss, damage, cost, or claim arising out of or in connection with any MercedesTrophy event, of any nature whatsoever and howsoever occurring (whether in tort (including negligence), contract, under statute or otherwise).

61.  For clarity, the MercedesTrophy events are subject to other third party supplier’s terms and conditions, and the Released Entities will not be responsible for any direct or indirect loss suffered by any participant as a result of the conduct of these third party suppliers.

62.  To the extent permitted by law each participant agrees to release and discharge the Released Entities from, and indemnify the Released Entities against, all losses, damage, costs, or claims referred to in clause 59 above, and agrees to waive all rights to make any claim against the Released Entities in respect of such loss, damage, cost or claim.

63.  Participants in the MercedesTrophy may be asked to produce proof of identity, age and place of residence and may be required to sign a legal release and indemnity in a form determined by MBNZ in its absolute discretion. If there is a dispute as to the identity of a participant, MBNZ reserves the right, in its sole discretion, to determine the identity of the participant.

64.  Neither MBNZ, MBNZ’s Retailers, nor MBAG makes any representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the website of the NZ Ministry of Foreign Affairs and Trade. The participants (and, where applicable, their travel companion) each participate and attend at their own risk.

65.  Any participant irrevocably entitles and allows MBNZ, its Retailers and MBAG in perpetuity throughout the world, and without any payment or liability to the participant, to use the participant’s photograph, name and likeness in connection with any promotion and/or advertising as MBNZ and/or advertising as MBNZ and/or its Retailers and/or MBAG deems fit. Participants agree that they will not sell or otherwise provide their story and/or photographs to any media or other organisation. Invitees agree to participate and co-operate, without remuneration, as required by MBNZ from time to time in all editorial activities relating to the MercedesTrophy, including but not limited to being interviewed and photographed.

66.  Each participant acknowledges and agrees that, notwithstanding anything to the contrary in these terms and conditions:

a.             MBNZ reserves the right, in its sole and unfettered discretion, to cancel or postpone any qualifying Retailer Golf Day, the National Final and/or the Drive to the Major (and/or to not give all or any part of the prize relating to the National Final, the World Final and/or the Drive to the Major) (including having regard to any government mandated or recommended COVID-19 lockdown requirements or social distancing guidelines);

b.            MBNZ reserves the right, in its sole and unfettered discretion, to change any of the qualification and participation criteria at any point in relation to any Retailer Golf Day, the National Final, the World Final and/or the Drive to the Major (including in relation to whether guests and spectators (and companions and partners) can attend);

c.             MBAG reserves the right, in its sole and unfettered discretion, to cancel or postpone the World Final (including having regard to any government mandated or recommended COVID-19 lockdown requirements or social distancing guidelines);

d.            MBAG reserves the right, in its sole and unfettered discretion, to change any of the qualification and participation criteria at any point in relation to the World Final (including in relation to whether guests and spectators (and companions and partners) can attend); and

e.             to the maximum extent permitted by law, neither MBNZ, nor any Retailer of MBNZ, nor MBAG will in any way be liable in respect of any loss or damage arising from any decision to cancel or postpone any one or more of any qualifying Retailer Golf Day, the National Final, the World Final and/or the Drive to the Major (and/or to not give all or any part of the prize relating to the National Final, or the World Final and/or the Drive to the Major) or to change any of the qualification and participation criteria at any point.

67.  In the event a prize, including any part of a trip (such as a flight or accommodation) relating to the National Final, the World Final and/or the Drive to the Major (or any part of any of them) becomes unavailable or is not given including for reasons beyond MBNZ’s control, MBNZ is not required to offer a substitute prize (or part prize).

68.  Any invitation to participate in a Retailer Golf Day, the National Final and/or the World Final is not transferrable or redeemable for cash.

69.  If an Invitee is invited to take part in the National Final (or, where applicable, the World Final) and is unable or unwilling to attend:

a.             the Invitee shall be deemed to forfeit the invitation;

b.            in no circumstances will the invitation be redeemable as cash and neither MBNZ, its Retailers, nor MBAG will be liable to compensate the participant in any way; and

c.             MBNZ may, in its sole and unfettered discretion, elect to invite another participant to take the Invitee’s place.

70.  The MercedesTrophy is an amateur series of events and, as such, no prize money is awarded.

71.  Participation in a Retailer Golf Day and the National Final is deemed acceptance of these terms and conditions. Participation in the World Final will be subject to such terms and conditions as are notified by MBAG.

72.  MBNZ collects personal information for the purposes of conducting the MercedesTrophy and may, for this purpose, disclose such information to third parties (including but not limited to, its Retailers, agents, contractors, service providers, offer suppliers and related companies) and for publicity purposed surrounding the MercedesTrophy. Participation is conditional on providing this information, which will be handled in accordance with the Privacy Policy available at www.mercedes-benz.co.nz. Participants can access and request correction of their personal information by contacting Mercedes-Benz New Zealand Limited at mbnz.enquiriesMBPC@daimler.com, Level 3, Office Tower, 277 Broadway, Newmarket Auckland or by calling +64 9 976 7500.

73.  Each participant in the National Final agrees to the terms and conditions of the Hole in One insurance policy applicable to the National Final, including terms and conditions relating to sharing player details (name and mobile contact number) for identification purposes with a third party, Oddson Promotions Limited. The participant acknowledges and agrees that the terms and conditions of the Hole in One insurance policy will be enforceable by Oddson Promotions Limited as if Oddson Promotions Limited was a party to these terms and conditions.

74.  The participant hereby consents to MBNZ and its related companies and Retailers sending marketing and promotional material via electronic commercial messages (e.g. email or text messages) and using the participant's personal information for promotional, marketing, publicity, research, profiling and customer satisfaction purposes, including sending electronic commercial messages to the participant.

76. The Retailer Golf Day and the National Final shall be under the management and control of the Tournament organisers (comprising of the Tournament Director, and a representative from MBNZ) whose decision on all matters relating to the MercedesTrophy shall be final and binding. The Tournament organisers will decide all disputes, and notwithstanding anything to the contrary herein reserves the right to change any tournament condition, any starting time and/or to alter the order of events.
